$3.5M Demand Ends in Defense Verdict in Orange County
Elham Rabbani and Mark Capell just received a Defense Verdict in a case where plaintiff waived all past medical bills in an effort to keep the liens from ever getting to the jury, by telling the court the liens had been paid, and it was working for most of the trial based on a relevance objection. Then plaintiff called in a lifecare planner and the defense cross examined them, and they confirmed the liens were still outstanding, which allowed the defense to get those liens into evidence, which has the plaintiff, attorney, and the doctors signature on them.
Ultimately, Plaintiff had 4 pain injections, and a 3 level cervical fusion, as well as a $840,000.00 lifecare plan. Their surgeon testified that they will need a future surgery in 5 years. That surgery was estimated to cost almost 200k. Plaintiff asked the jury for $3,569,874.36. Defense argued the sudden emergency defense.
The jury deliberated for 1hour and 45mins. Verdict for the Defense. No negligence and no substantial factor.
